Growth Acquisition System Terms of Purchase and Participation

Growth Acquisition System

The Growth Acquisition System is a guided business implementation program designed to help participants strengthen the systems connected to how their business gets seen, gets booked, gets paid, encourages return visits, and receives referrals.

GAS includes training, implementation guidance, resources, templates, systems, technology access, community access, and other materials as described on the applicable sales or checkout page.

Except for components specifically identified as including lifetime access, your GAS purchase provides 12 months of program access beginning on the date access is provided.

30 Day Implementation Period

GAS is designed to guide participants through the primary implementation process during their first 30 days.

During the implementation period, participants will receive access to the training, resources, implementation guidance, and support needed to work through the applicable GAS implementation process.

Training and implementation guidance may be delivered through recorded training, live sessions, written resources, demonstrations, community support, or a combination of delivery methods. The specific format may vary based on the version of GAS purchased or the participant's enrollment period.

Participants will also have access to the Growth Support Hub, where they may ask questions and receive support according to the support procedures communicated within the program.

The 30 day timeline represents the intended implementation schedule. Completion within 30 days depends on the participant completing the required actions, providing requested information, reviewing applicable training and resources, making required business decisions, and implementing the processes as instructed.

Marketing Funnelista does not guarantee that every participant will complete implementation within 30 days.

Participant Responsibilities

GAS is a guided implementation program and requires active participation.

You are responsible for completing the applicable implementation steps, providing accurate and complete information, reviewing applicable training and resources, making required business decisions, and taking the actions necessary to implement the systems in your business.

You are also responsible for ensuring that your business practices, advertising, communications, services, policies, and use of the systems comply with laws and regulations applicable to your business and industry.

Your implementation and results may be affected if you delay implementation, skip required steps, provide incomplete or inaccurate information, substantially modify the provided processes, or fail to use the systems as instructed.

Program Access

Your GAS purchase includes 12 months of access to the Growth Acquisition System beginning on the date program access is provided.

During the 12 month access period, you will have access to the GAS training, materials, resources, and other program components included with the version of GAS you purchased.

The active guided implementation and implementation support period is 30 days.

Your purchase also includes 12 months of included ClickFunnels access and lifetime access to the Growth Support Hub, as further described in these Terms.

Continued access to GAS materials after the initial 30 day implementation period does not include ongoing private implementation, custom consulting, unlimited troubleshooting, or additional implementation services unless separately agreed to in writing.

Growth Support Hub

Your GAS purchase includes lifetime access to the Growth Support Hub.

The Growth Support Hub is the ongoing GAS community where participants may connect, access applicable community resources, ask general questions, and receive continued growth support after the initial 30 day implementation period.

Marketing Funnelista may move the Growth Support Hub to another platform, reorganize its content or features, or make reasonable changes to how the community operates.

Lifetime Growth Support Hub access does not include lifetime private consulting, custom implementation, individual technical support, or ongoing done for you services unless specifically stated otherwise.

ClickFunnels Access

Your GAS purchase includes access to ClickFunnels for 12 months.

After the included 12 month period ends, you may choose whether to continue using ClickFunnels. If you choose to continue, you will be responsible for the applicable ongoing subscription cost.

The anticipated continuation cost is currently $97 per month. Because ClickFunnels is a third party platform, its pricing, features, policies, and availability may change.

Marketing Funnelista does not own or control ClickFunnels and cannot guarantee its continued availability, functionality, features, policies, or future pricing.

Other Third Party Tools and Expenses

Unless specifically stated as included with your GAS purchase, you are responsible for the cost of third party software, services, advertising, domains, email or SMS usage, payment processing, external booking systems, and other tools you choose or need to operate your business.

If you choose to use an external booking platform or another third party solution, the cost of that platform or service is your responsibility.

Marketing Funnelista is not responsible for outages, errors, account restrictions, policy changes, discontinued features, pricing changes, or other actions of third party platforms and service providers.

Purchase Price and Payment

The purchase price for GAS is the amount displayed and accepted at checkout.

Unless a separate written payment arrangement is approved by Marketing Funnelista, payment is due according to the terms presented at the time of purchase.

Payment plans are not publicly offered as a standard GAS purchase option. Marketing Funnelista may, at its discretion, approve an individual payment arrangement upon request.

If an individual payment arrangement is approved, the total purchase price, payment amounts, and payment schedule will be documented separately in writing.

An approved payment plan is an installment arrangement for payment of the full purchase price of GAS. It is not a month to month subscription or cancel anytime membership. Agreeing to a payment plan does not reduce the total purchase price or allow the participant to cancel remaining payments by discontinuing participation.

Failure to make an agreed payment may result in suspension of program, platform, or Growth Support Hub access until the account is brought current.

Refund Policy

Because GAS provides access to intellectual property, resources, technology, training, implementation guidance, community resources, and digital materials, a participant's decision not to attend or review training, access materials, complete implementation, use the systems, or continue participating does not create a right to a refund.

The 60 Day Implementation Support Promise described in these Terms provides the available remediation for qualifying implementation issues within the scope of that promise.

60 Day Implementation Support Promise

We want participants who follow the GAS implementation process to have support when an included part of that process is not working as intended.

The 60 Day Implementation Support Promise begins on the date your GAS program access is provided and continues for 60 calendar days.

If you have completed the implementation steps applicable to an issue and followed the provided process as instructed, you may submit a specific implementation issue to Marketing Funnelista for review.

If an included GAS deliverable, setup, or documented implementation process is not working as intended, Marketing Funnelista will review the issue and provide reasonable troubleshooting, corrections, or guidance necessary to address the qualifying issue within the original scope of GAS.

This promise does not require Marketing Funnelista to provide additional systems, custom development, new services, unlimited revisions, ongoing private consulting, or work outside the original scope of GAS.

The promise does not apply when an issue results from incomplete or incorrect implementation, substantial changes made by the participant or another third party, inaccurate or incomplete information supplied by the participant, use of the system in a manner inconsistent with the provided instructions, or an outage, limitation, policy change, technical issue, or other circumstance caused by a third party platform or service.

No Guarantee of Business Results

Marketing Funnelista provides systems, education, implementation guidance, resources, and support. We do not guarantee any particular business or financial result.

We do not guarantee a specific number of leads, inquiries, bookings, clients, return visits, referrals, sales, revenue, profit, advertising results, conversion rates, or other business outcomes.

Business results depend on many factors outside Marketing Funnelista's control, including the participant's implementation, services, pricing, market, audience, location, competition, advertising, client experience, business decisions, and other circumstances.

Examples, testimonials, case studies, projections, or discussions of potential results are illustrative and should not be interpreted as a promise that you will achieve the same or similar results.

Founding Member Participation

Certain participants may be invited to join the Growth Acquisition System as Founding Members.

Founding Members are part of the initial implementation group for GAS. In addition to receiving the GAS program they purchased, Founding Members receive special Founding Member pricing and live guided implementation during their initial 30 day implementation period.

Because Founding Members are participating in the initial implementation of GAS, they also have an opportunity to help Marketing Funnelista evaluate and refine the program through their experience and feedback.

Founding Member Feedback

By accepting a Founding Member position, you agree to actively participate in the GAS implementation process and provide reasonable feedback about your experience.

This may include responding to feedback requests, completing surveys, identifying areas of confusion, reporting implementation issues, and sharing observations about the training, resources, systems, implementation process, support, and overall GAS experience.

Marketing Funnelista may use Founding Member feedback internally to evaluate, modify, improve, and develop GAS without additional approval.

Internal use of feedback does not authorize Marketing Funnelista to publicly identify you or publicly attribute specific statements to you without permission.

Program Refinement

Founding Members understand that they are participating in the initial implementation of GAS.

The core offer purchased by Founding Members will be provided as described, but aspects of the training, resources, implementation process, technology, delivery methods, support procedures, and other program components may be refined as Marketing Funnelista learns from the Founding Member implementation experience.

Reasonable refinements or improvements to GAS do not constitute a failure to deliver the program, provided that the changes do not materially reduce the core benefits purchased by the Founding Member.

Founding Member Program Updates

During their 12 month GAS access period, Founding Members will receive access, at no additional charge, to new or updated GAS training, resources, templates, and program improvements that Marketing Funnelista releases and makes part of the Growth Acquisition System during that period.

This Founding Member benefit applies only during the participant's 12 month GAS access period and does not extend or renew the access period.

This benefit applies to updates and additions made to the Growth Acquisition System itself. It does not include separate products, programs, services, private consulting, custom implementation, or other offers that Marketing Funnelista may create or sell separately.

Founding Member Session Recordings and Training Use

Founding Member live implementation sessions may be recorded.

By participating in a recorded Founding Member session, you understand that the recording may capture your name, voice, image, questions, comments, business information, or other information you voluntarily share during the session.

Recordings may be made available to Founding Members as part of their GAS program access.

Marketing Funnelista may edit, organize, excerpt, or convert Founding Member session recordings into GAS training and educational materials for current or future GAS participants.

Marketing Funnelista will make reasonable efforts not to include confidential or highly personal information that is unnecessary for training purposes.

If you share information during a session that you do not want included in future GAS training materials, you may notify Marketing Funnelista and reasonable efforts will be made to exclude that portion from future training use.

Permission to use Founding Member session recordings for GAS training and educational purposes does not automatically authorize use of a participant's name, image, business, story, or results in unrelated advertising or promotional materials.

Founding Member Testimonials and Case Studies

As a Founding Member, you agree that Marketing Funnelista may request your reasonable participation in developing a testimonial or case study about your GAS experience.

This may include requests to discuss your experience, implementation progress, feedback, and business results.

Your agreement to participate does not authorize Marketing Funnelista to misrepresent your experience or results.

Marketing Funnelista may use nonidentifying or aggregated feedback internally for program evaluation and improvement without additional approval.

Intellectual Property and Permitted Use

All GAS training, frameworks, systems, templates, resources, recordings, written materials, processes, methods, graphics, presentations, documents, and other program materials provided by Marketing Funnelista remain the intellectual property of Marketing Funnelista or the applicable rights holder.

Your purchase grants you a limited, nonexclusive, nontransferable right to use GAS materials for your own business.

You may customize applicable templates and resources for use within your own business.

You may not reproduce, resell, license, distribute, publish, teach, share, upload, transfer, or provide GAS materials or access credentials to another person or business without prior written permission from Marketing Funnelista.

Your purchase does not transfer ownership of the Growth Acquisition System, its frameworks, training, templates, methodology, or other proprietary materials to you.

Community Standards

Participants are expected to interact respectfully and professionally within the Growth Support Hub, implementation sessions, and other GAS communication channels.

Harassment, abusive behavior, unauthorized solicitation, spam, distribution of another participant's confidential information, unauthorized sharing of program materials, or conduct that materially interferes with the experience of other participants may result in restricted or terminated access.

Termination for serious misconduct or violation of these Terms does not automatically create a right to a refund.

Confidentiality

During GAS, participants may receive access to nonpublic Marketing Funnelista information and may also encounter information shared by other participants about their businesses.

You agree not to disclose another participant's confidential business or personal information outside the program without their permission.

Marketing Funnelista will likewise use reasonable care when handling nonpublic information you provide in connection with your participation, subject to our Privacy Policy and any disclosures required by law.

Suspension and Termination of Access

Marketing Funnelista may suspend or terminate access for material violations of these Terms, unauthorized sharing or distribution of GAS materials, abusive or disruptive conduct, misuse of program resources, or failure to make payments required under an agreed payment arrangement.

Where reasonable under the circumstances, Marketing Funnelista may provide an opportunity to correct a violation before terminating access.

Termination or suspension resulting from a participant's violation of these Terms does not eliminate outstanding payment obligations and does not automatically create a right to a refund.

Third Party Platforms

Certain parts of GAS may rely on third party software, websites, applications, integrations, payment processors, communication platforms, or other services.

Marketing Funnelista does not control these third parties and cannot guarantee their uninterrupted availability or continued compatibility with GAS.

When a third party changes its technology, policies, features, pricing, or availability, Marketing Funnelista may modify its recommended implementation process or substitute another reasonable solution when appropriate.

Scope of GAS

Your GAS purchase includes only the products, services, support, access, and deliverables expressly identified as part of the Growth Acquisition System.

Requests for additional custom work, private consulting, technical implementation, integrations, design, copywriting, advertising management, or other services outside the included GAS scope may require a separate agreement and additional payment.

Disputes and Payment Concerns

If you believe there has been a billing error or that Marketing Funnelista has not provided something included in your GAS purchase, you agree to contact Marketing Funnelista promptly so that we have a reasonable opportunity to investigate and address the concern.

Nothing in this section eliminates any rights or remedies that cannot legally be waived.

Limitation of Liability

To the fullest extent permitted by applicable law, Marketing Funnelista will not be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in GAS, use of program materials, business decisions made by the participant, or use of third party platforms.

To the fullest extent permitted by applicable law, Marketing Funnelista's total liability arising from your GAS purchase will not exceed the amount you actually paid to Marketing Funnelista for GAS.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

Changes to Program Delivery

Marketing Funnelista may make reasonable changes to program schedules, communication platforms, technology, resources, training formats, or methods of delivery when necessary to operate, update, or improve GAS.

Training may be delivered through live sessions, recorded materials, written resources, demonstrations, community support, or a combination of methods.

A change in delivery format does not constitute a failure to provide GAS as long as the participant continues to receive the core program components applicable to the version purchased.

Marketing Funnelista will not materially reduce the core benefits purchased by a participant without providing a reasonable alternative.

Governing Law

These Terms and any dispute arising from your purchase of or participation in GAS will be governed by the laws of the State of Maryland, without regard to conflict of law principles.

Relationship to Other Policies and Agreements

These Terms govern the purchase of and participation in the Growth Acquisition System.

Marketing Funnelista's Website Terms of Use govern general use of its website, and its Privacy Policy governs the collection and handling of personal information.

If a participant separately purchases custom services from Marketing Funnelista, those services may be governed by a separate written agreement.

If a specific written agreement signed by Marketing Funnelista expressly conflicts with these Terms regarding the same purchase or service, the specific written agreement will control with respect to that conflict.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Entire Agreement

These Terms, together with the applicable checkout or order information and any written payment arrangement specifically applicable to your GAS purchase, constitute the agreement between you and Marketing Funnelista concerning your purchase and participation in GAS.
